Jack MacDonald

Biography

Jack is an associate specializing in intellectual property monetization and litigation. With a strong focus on clients in creative industries, Jack works with inventors, innovators, artists, and producers, offering expert legal counsel to help protect and grow their businesses. 

Jack has represented multinational pharmaceutical and telecommunication companies in complex patent litigation, negotiated rights agreements with podcast producers, and advised cannabis producers marketing their products in compliance with Canada’s complex regulatory frameworks. He also frequently supports clients in sports and entertainment, providing strategic guidance on a range of commercial legal matters.

Jack received his law degree from Dalhousie University in Halifax, Nova Scotia and has a degree in mechanical engineering from the University of Manitoba. 

Outside of the office, Jack is a passionate consumer of all things pop culture and stands firm on his opinion that Flea Bag is the greatest television show of all time. He plays the bass guitar (primarily rock and funk) and has recently joined a curling league (still looking for his first win).

  • Fresenius Kabi Deutschland GmbH v Samsung Bioepis Co, Ltd, Federal Court File No. T-2009-19, T-462-21: represented plaintiff in patent impeachment proceedings in relation to a formulation patent for adalimumab biosimilars.
  • Light Music Inc v Jones Media Inc, SC1800009824: represented plaintiff in contractual dispute. 
  • Haudenosaunee Development Institute v Ontario Energy Board et al, ONSC File No. 006/23: represented plaintiff in an appeal concerning an energy project.
  • Swist v MEG Energy Corp, 2021 FC 10: represented plaintiff in patent infringement matter against MEG Energy relating to oil extraction. 
  • HDI v Her Majesty the Queen in Right of Ontario, as represented by the Ministry of Energy, ONSC File No. 422/22: represented plaintiff in an application for judicial review concerning an energy project.
  • HDI v Ontario Energy Board et al, ONSC File No. 458/22: represented plaintiff in an appeal concerning an energy project.
  • Six Nations of the Grand River Band of Indians v Canada, et al, ONSC File No. CV-18-594281: represented an indigenous organization in a motion for party status.
  • Haudenosaunee Development Institute v Metrolinx, ONSC File No. CV-23-694346: counsel to applicant in injunction application concerning removal of trees at Osgoode Hall in Toronto (reported in the Toronto Star).
